<p>When you think of extravagance and splendour, the Mughal Empire immediately springs to mind, its legacy twinkling in the gems that adorn its history. From luxuriously carved turban ornaments to richly coloured necklaces dripping with lush stones, Mughal jewellery paints a picture of opulent artistry and cultural richness that continues to resonate today.</p>

<p>The Mughals were not just rulers; they were connoisseurs of beauty. Shimmering across South Asia from the 16th to the 19th centuries, the Mughal court was marked by an unmatched passion for the opulence of jewels. Exquisite diamonds, vibrant emeralds, luscious rubies and exceptional pearls were their treasures. These royal gemstones were not merely decorative; they represented power, wealth and artistry – a glimmering narrative of the greatness of an empire that once spanned present-day Afghanistan, Pakistan and Bangladesh as well as India and beyond.</p>

<p>The Mughal treasury was legendary, rumoured to contain inestimable riches in  gold, silver and jewels that would make even the wealthiest modern magnate gawk in admiration. The opulence was tangible; just consider the Peacock Throne, the 17th-century solid-gold and gem-encrusted seat of power of the fifth Mughal emperor, Shah Jahan. Deemed to be one of the wonders of the world, it symbolised absolute power and splendour.</p>

<p>The vastness of the Mughals’ wealth and the sheer artistry displayed in their treasures were the envy of all who came to pay their respects. In a practice as diplomatic as dazzling, intricate gem-studded jewels would be gifted to foreign dignitaries or presented as tokens of love in strategic alliances. Wealthy princesses were arrayed in priceless dowries to secure political ties, with exquisite pieces carefully chosen not just for beauty but also as measures of worth and influence.</p>



<h3 class="wp-block-heading">Royal Bling</h3>



<p>Mughal jewellery is a story woven in gold and gemstones. Each piece tells a tale of luxury, craftsmanship and the complexity of status. The jewels were powerful symbols, often displayed by emperors to signify their authority. Turban ornaments, for instance, nodded to royal lineage. The sarpech or jigha, crafted in gold and studded with brilliant stones, displayed elegance and functionality. The design often included a majestic feather and was reminiscent of the emperor’s sceptre.</p>

<p>Among the crowning glories of the era was the famous Great Mogul Diamond. Discovered amid the rich Golconda mines of southern India in 1650, this magnificent stone weighed a staggering 280 carats. Resembling half a chicken’s egg in size and shape, it was gifted by a wealthy general, Emir Jemla, to Shah Jahan. Tales swirl around this famous diamond, especially that of French traveller Jean-Baptiste Tavernier, who marvelled at its brilliance and sketched its image in 1665.</p>

<p>However, the diamond’s tale took a dramatic turn when it was looted by Persian ruler Nader Shah in 1739, along with the Peacock Throne, and disappeared into the pages of history. Some say it was later recut into the Orlov Diamond, a shard of Mughal majesty residing in the Russian imperial sceptre now displayed at the Kremlin.</p>



<h3 class="wp-block-heading">Ornate Armoury</h3>



<p>Not just about ornamentation, Mughal jewellery also served practical purposes. The bazuband, worn around the upper arm and adorned with gemstones, offered protection in battle while serving as an ornate declaration of wealth and prowess. Inherently functional yet intricately beautiful, items like dagger handles were crafted from precious metals, integrating luxury into everyday life. The Mughal armoury reflected not only martial readiness but also an appreciation for artistry that time has not forgotten.</p>

The appeal of gemstones also ran deep; with diamonds symbolising strength and emeralds embodying renewal, they were chosen as much for their physical beauty as for their spiritual significance.</p>



<h3 class="wp-block-heading">Embedded Artistry</h3>



<p>With unparalleled advancements in jewellery craftsmanship, the Mughal era is also synonymous with innovation. Techniques such as kundan, meenakari and jadau created masterpieces of unrivalled elegance. Kundan involved meticulous craftsmanship wherein gold foil secured stones in place, achieving a seamless finish and enhancing the brilliance of each gem.</p>

<p>Visitors to London this month can revel in such marvels, as the V&amp;A presents, until 5 May, an exhibition of <em>The Great Mughals: Art, Architecture and Opulence</em>, showcasing the extraordinary creativity and culture that characterised the reigns of emperors Akbar, Jahangir and Shah Jahan.</p>

Modern jewellers, like the talented Hanut Singh, are skilfully combining traditional artistry with contemporary flair, creating dazzling pieces that appeal to a cornucopia of tastes.</p>

<p>The heritage is not only the product we do; the heritage is the way to do it, the spirit. It was the case of Pierre Jaquet-Droz from 1738, nearly 300 years ago; he was always finding a new approach.He was a disruptive person at that period of time, so we must continue in that vein. Respecting him is to continue to be disruptive.</p>

<p>We wanted to fully respect the past and the legacy. It is worth remembering &nbsp;that Pierre Jaquet-Droz was traveling to the courts of Europe, to the King of Spain, the King of Great Britain, the King of France, even to the Emperor in the Forbidden City in Beijing, China.</p>

<p>We decided, if we want to respect that, we should make a piece of art; it&#8217;s not watches anymore, they are pieces of art. And we should make a piece of art for the kings. But who are the kings today?</p>

<p>The ‘King’ today is the customer who can afford to buy a real piece of art with all the materials and know-how. &nbsp;We do then only pieces for kings, which means only, I must say, very expensive pieces.</p>

<p>Furthermore, as long as we make everything in-house, engraving, painting, why should we try to do the samepiece twice? I prefer the engraver, the painters, to do every time another painting, another engraving.</p>

<p>So, we concluded, we will only do unique pieces.</p>

<p>Customersfirst have to come to see the artist to know what they want to do. And then we have facilities inside a studio, like a TV professional studio with six 4K cameras.The customer does not have to come back to the manufacture every three weeks to see the evolution of the creation of his piece of art. He can talkand he can influence the artist &#8211; &nbsp;to engrave like this or do it like that.</p>

<p>This is a phygital approach we construct at the manufacture to increase personal contact as well as use modern technology to be able to follow the process.</p>



<h3 class="wp-block-heading">Why are you convinced luxury and sustainable development are not incompatible?</h3>



<p>They are not at all. I come from the hotel business and from the beginning I was convinced that it is a mission for the people who have a lot of money to show the right rules in the right ways. It is compatible with the sustainability approach.</p>



<h3 class="wp-block-heading">Any other comments?</h3>



<p>I believe that you cannot construct and clarify the future without knowing where you come from. We are a startup which is nearly 300 years old. It&#8217;s unusual.</p>

[Feature Story by Lantau Yacht Club] Hong Kong’s latest outdoor wedding venue – Where sea meets sophistication


<p>Few performers mirror the complexity of human experience with as much raw talent and charm as Jonathan Bailey. Celebrating his 37th birthday this month, the <em>Bridgerton</em> and <em>Fellow Travelers</em> star can credit an abundance of perseverance and passion for his successful move from child actor to major stage and screen presence. With accolades lining the walls of his career ¬– including a Laurence Olivier Award and a Critics’ Choice Television Award, Bailey’s trajectory signifies more than just talent; it represents the evolution of an artist willing to transcend boundaries.</p>

<p>His childhood in the countryside of Oxfordshire, England, amid the nurturing gazes of four remarkable women – his mother and three elder sisters – and a father with unwavering resolve shaped Bailey’s outlook on life. His passion for acting ignited at the tender age of five when a family outing to London to see a production of <em>Oliver!</em> planted the seed of ambition in his young mind. “That was my awakening moment,” he recalls. “I was transfixed by the magic of storytelling and the ability to transport people into different worlds.”</p>

<p>His early years were marked by performances that honed his craft, starting with primary-school plays and continuing onto stage roles with the Royal Shakespeare Company. He starred as Gavroche in a West End production of <em>Les Misérables</em> at the age of eight. Enveloped in a cocoon of creativity and ambition, he headed to the bright lights of greater stages – a path he decided to embrace fully, forgoing drama school in favour of real-world experience.</p>

<p>Bailey’s ascent in the acting world gained momentum through a host of versatile portrayals. He broke into British television playing a university freshman in the comedy <em>Off the Hook</em> (2009) and a teenage Leonardo da Vinci in <em>Leonardo</em> (2012-12), but it was his role as the earnest journalist Olly Stevens in the critically acclaimed series <em>Broadchurch</em> (2013-15) that saw him capture hearts. While that show bolstered his reputation as a dynamic actor, it was the theatre that truly showcased the depth of his artistry.</p>

<p>Appearances in classic plays like <em>Othello</em> (2013) and contemporary works such as <em>The York Realist</em> (2018) served to solidify his status as a leading man of modern theatre. “The theatre is where I feel most secure,” he explains. “There’s a tangible energy from the audience that compels me. I thrive off their reactions.”</p>

<p>It was also in 2018 that Bailey took a significant leap, stepping into the gender-swapped role of Jamie in a new production of the 1970 Stephen Sondheim musical, <em>Company</em>. His award-winning performance dazzled critics, marking him as a swift and nimble presence on stage. “Performing <em>Getting Married Today</em> every night felt exhilarating – it was my playground,” he recalls.</p>



<h3 class="wp-block-heading">Finding Freedom in Fame</h3>



<p>Yet, it was portraying Lord Anthony Bridgerton in the ongoing Netflix series <em>Bridgerton</em> that catapulted Bailey to global fame, serving as both a blessing and a complicating chapter of his life. The first season (2020) took social media by storm, garnering massive viewership and shadows of adoration mixed with scrutiny.</p>

<p>“Initially, I was overwhelmed by the fame,” he admits candidly. “It felt hard-hitting, like being thrust into this whirlwind. But the support system around me has been vital.”</p>

<p>As he navigates the glamorous yet complicated world of stardom, Bailey remains firmly rooted in his passion for storytelling and finds safety once again in a return to the theatre. He plays the titular role in <em>Richard II</em>, which runs at London’s Bridge Theatre until 10 May. “The stage has this protective aura – it’s immersive and liberating,” he reflects. “You get to explore life through characters, almost like dress-rehearsing your own existence.”</p>

<p>His collaboration with director Nicholas Hytner marks a significant homecoming for the actor, and one that has been a foundational part of his career. “Nicholas gave me my biggest break as Cassio in <em>Othello</em>. The generally private Bailey, who came out publicly as gay in 2018, reveals: “Yes, I desire children – it’s such a privilege for a man. But I’m conscious of my current [busy] lifestyle. I want to ensure that if and when the time comes, I can be present.”</p>

<p>Amid the glamour of fame, Bailey emphasises the importance of giving back to the community. Through his charitable efforts with Just Like Us and The Shameless Fund, which he launched last summer, he strives to raise awareness and support for LGBTQ+ issues globally. “If I can fill the spaces that I didn’t have while growing up, I feel that’s a brilliant thing,” he states.</p>

<p>The interior of Ghost Series II celebrates craftsmanship, both analogue and digital. Housed in the new pillar-to-pillar glass panel, the Central Information Display incorporates the marque’s advanced operating system. This enables clients to extend their Bespoke commission from hardware to software as the colour of the digital instrument dials can now be tailored to complement the motor car’s interior palette or exterior finish.</p>

Rear seat passengers can now connect up to two streaming devices to the rear screens, stream independently on each screen, and select their preferred entertainment from a newly developed interface, which also manages seating functions such as massaging, heating and cooling. Bluetooth® headphones of any type can be paired with the rear seat infotainment system, and all occupants benefit from an upgraded Wi-Fi® hotspot and USB-C® charging ports hidden discreetly in the centre console.</p>



<h3 class="wp-block-heading"><strong>C</strong>ontemporary craft</h3>



<p>Ghost Series II benefits from bold new expressions of contemporary craft, meticulously conceived by the marque’s artisans. Alongside the Central Information Display, on the passenger side, is the new Spirit of Ecstasy Clock Cabinet. This vitrine houses an analogue timepiece and an up-lit, mirror-polished, solid stainless-steel Spirit of Ecstasy figurine. She is placed on a stage with a matte black back panel and high gloss side panels to create a reflection effect. On entering the motor car, the Spirit of Ecstasy is initially illuminated from below, as if she is being lit by a spotlight, before her stage lighting settles to a soft glow.</p>

<p>Ghost Series II continues Rolls-Royce’s exploration of textiles with Duality Twill, a new rayon fabric made from bamboo, first introduced with the Cullinan Series II. Inspired by the bamboo grove near Sir Henry Royce’s former winter home in South of France, the twill textile features an embroidered ‘Duality’ graphic, reflecting the interlinked initials of the brand&#8217;s founders and evoking nautical themes reminiscent of sailing yachts along the French Riviera. Developed over a year in collaboration with a master weaver, this intricate textile requires 20 hours to construct and incorporates up to 2.2 million stitches and 11 miles of thread. Each piece is meticulously crafted and laser-cut for precision. The base textile is available in three colours — Lilac, Chocolate, and Black — with clients able to select from 51 thread colours.&nbsp;</p>



<h3 class="wp-block-heading">Superb Engineering</h3>



<p>At the heart of Ghost Series II is the marque’s uncompromising, potent and near-silent 6.75-litre twin-turbocharged V12 petrol engine and hallmark eight-speed gearbox, enabling all-wheel steering and all-wheel drivetrain. Maximum torque is available from just 1,600rpm – only 600rpm above tick-over, creating the perception of one, endless gear and the unique ‘waftability’ associated with the Rolls-Royce experience.</p>

<p>The gleaming transformation of Hong Kong’s old airport in East Kowloon – once the end point for perhaps the most perilous and nerve-racking descent in aviation history – into the magnificent new Kai Tak Sports Park is undoubtedly a huge lift for the city. Spanning 28 hectares, it is the largest sports, entertainment and mega-event complex in Hong Kong history, and shining at its centrepiece is a spectacular 50,000-seat stadium. </p>

<p>Indeed, Hong Kong Chief Executive John Lee didn’t hold back in highlighting the significance of the sports park during its opening ceremony on 1 March. He also marvelled at the engineering achievements it embraces. Kai Tak Stadium, for instance, boasts one of the largest opening and closing canopies in the world, a flexible pitch system that switches from natural turf to other surfaces, and other advanced design features, enabling it to host a variety of large-scale events in different weather conditions. </p>

<p>Aside from flying Hong Kong’s flag as a world-class venue for mega-events, the impressive development located on the site of the former Kai Tak airport offers a host of other attractions, including an indoor arena, a public sports ground, a retail and leisure mall, a waterfront dining area, an outdoor theatre and open spaces for public enjoyment. It was constructed at a cost of HK$30 billion.&nbsp;</p>



<h3 class="wp-block-heading">Arena applause</h3>



<p>Kai Tak Sports Park has already played host to world-class events, most notably snooker’s World Grand Prix and the recent Hong Kong Rugby Sevens. The former took place at Kai Tak Arena, the park’s indoor sports and community-events centre that has the flexibility to seat up to 10,000 people. </p>

<p>Bringing this premier snooker tournament to Hong Kong was undoubtedly a major coup, and it was considered a resounding success by many within the sport. The head of the World Snooker Tour, Simon Brownell, opined that Hong Kong is now one of the best places in the world to put on snooker tournaments, a sentiment echoed by others, including reigning world champion Kyren Wilson. </p>

<p>Kai Tak Arena’s inaugural major event did not pass completely smoothly, however. The last-minute withdrawal of seven-time world champion Ronnie O’Sullivan for health reasons was a setback. Although O’Sullivan’s superstar status was surely missed, the quality of the snooker on display throughout the tournament was of such a high order that this loss was less significant. </p>

<p>A teething problem saw the ejection of fans from the arena before the conclusion of a match because transport services would end at midnight. Images of spectators being herded out were viewed around the world, casting local officialdom in a rather negative light. Brownell, though, indicated that Hong Kong’s reputation as a successful event manager would not suffer as a result of this unfortunate one-off curfew.</p>



<h3 class="wp-block-heading">World-class goal</h3>



<p>According to Roy Ying, a Senior Lecturer in Marketing at the Hang Seng University of Hong Kong, the incident serves as reminder of the importance of meticulous planning and effective communication when organising major events. He believes Hong Kong must enhance its ability to deliver world-class experiences and invest in nurturing event-management talent in order to meet its goal of becoming the go-to destination for international events. </p>

<p>One positive in terms of crowd management is that Kai Tak Sports Park utilises Easy Leave, Hong Kong’s first AI-based real-time crowd data analysis platform, to facilitate the swift and safe departure of attendees from the complex. &nbsp;</p>



<h3 class="wp-block-heading">Stadium for the stars</h3>



<p>The park’s star venue, Kai Tak Stadium, served as the cauldron of world-class rugby during the Hong Kong Sevens at the end of March, and is set to welcome other major sporting events within the year. As the Chief Executive stated during its unveiling last month, a number of events in the 15th National Games, jointly organised by Guangdong, Hong Kong and Macau, will be held here in November. He added: “And you can count on scores of concerts by top singers and bands from home and abroad, here to raise the roof of Kai Tak Stadium.” </p>

<p>Fans of Coldplay and Nicholas Tse will certainly pack it to the rafters this month. To namedrop a few more, Singaporean singer-songwriter JJ Lin will take to the stage next month, the first Mandopop star to do so. In June, it will be the turn of Taiwanese superstar Jay Chou to hold court at three sold-out concerts.</p>

<p>The sparkling new stadium is seen by players in the travel industry as a potential game-changer in the battle with Singapore to attract major acts to Hong Kong. However, after losing out to the Lion City last year in the race to sign up Taylor Swift, the recent announcement that Lady Gaga’s Asia stop next month on her world tour will take place at the Singapore National Stadium is another big disappointment for Hong Kong. </p>

<p>Despite this, Travel Industry Council Chairman Tommy Tam believes the city now has far more leverage to attract top stars in the future. Kai Tak Stadium and the sports park as a whole are important milestones in the ability of Hong Kong to provide to diversified offerings to tourists. &nbsp; &nbsp;</p>



<h3 class="wp-block-heading">Terrific turf</h3>



<p>Facilities at the complex are certainly of the highest standard, in line with those of world-class sports and entertainment destinations overseas. Impressively, the park’s public sports ground, Kai Tak Youth Sports Ground, which has a capacity of 5,000, utilises Lay and Play technology, in which hybrid carpet pitches are grown off-site and then installed. Offering the advantages of faster pitch recovery and more flexible event scheduling, the system is widely used in top European stadiums. Thus, its pitch quality should be on a par with English football stalwarts Anfield, Wembley Stadium, and London Stadium, which was built for the 2012 Olympic Games and is now West Ham United’s home ground.</p>

<p>“The turf system is like a carpet with natural and artificial grass fibres attached to it,” explains Daniel Fan, Operations Manager of Kai Tak Sports Park. “After the carpet is laid, it only requires filling with a layer of lightweight planting sand and simple grooming to stand upright, ensuring it is readily available for use in sporting events. This innovative technology is not only efficient in establishing a high-quality playing surface instantly but also eliminates the lengthy planting process, making turf care and maintenance more flexible.”</p>



<h3 class="wp-block-heading">Green glory</h3>



<p>A raft of green and sustainable features was incorporated into Kai Tak Sports Park during the design and construction phases. To outline just a few, there are more 1,000 trees to reduce urban heat island effect and improve visual comfort; all buildings feature advanced ventilation and green aspects to improve air quality and reduce carbon emission; and charging facilities for electric vehicles are provided at all private car parking spaces.</p>

<p>Despite the recent strong performances of Hong Kong universities, the attraction of an overseas education shows no sign of abating for many local students. Families are prepared to fork out the additional fees and expenses required to study abroad since it is still seen as a passport to a golden future. The UK, the US, Australia and Canada are the destinations most preferred.</p>

<p>For many local pupils, boarding overseas is a stepping stone to a top international university. Take the experience of young Hong Kong professional Frankie, who went to England aged 17 to study A-levels, then went on to a good university. “I chose to study abroad because it could raise my chances of getting into a top university,” he shares. “During my time in the UK, I gained a lot of international exposure as my university attracted students from all around the world.”</p>

<p>These sentiments are familiar to Gerry Chu, Director of Apply Ivy, a company which helps students prepare for and apply to competitive boarding schools and universities abroad, primarily in the US, the UK and Canada. Many of his young clients attend international schools in Hong Kong, and they are typically interested in building on their existing experience by gaining an international perspective at secondary or tertiary level.</p>

<p>“Another reason for studying abroad is that students may have different career options available to them upon graduation,” he says. Attending a US college is preferred by some since it allows the exploration of different courses while a student decides a future career path.</p>

<p>Time spent studying overseas also brings the benefit of fostering a spirit of independence. “Often, with this independence, young people are more likely to have varied life experiences,” he notes. “They are given opportunities to succeed and fail, which provide meaningful life lessons.”</p>

<p>Chu says many students choose their destination based on previous knowledge of that country from family, friends, or past visits. “Everyone has a unique situation, perspective and set of goals that will guide them in their decision-making process,” he adds, citing geography, culture, language, weather, area of study, and future career prospects as some of the considerations.</p>

<p>He advises doing as much prior research as possible; visiting the schools and universities before applying, if possible; and attending summer programmes abroad to get a better sense of life away from home in another country.</p>



<h3 class="wp-block-heading">Superior education</h3>



<p>For Garth Grierson, the founder of Art Curators Hub and a former international school Head Teacher, one of the top draws of an overseas education is the potential for academic excellence. “Very often pupils at these private schools attain a superior academic standard,” he says. “They are far more disciplined and more motivated as they are competing with some of the best students in the world. This is contagious.”</p>

<p>He notes that most pupils embarking on an overseas education will feel homesick at some point during their stay. “This is normal, and as they adapt to their new environment, this seems to disappear.”</p>



<h3 class="wp-block-heading">Boarding troubles</h3>



<p>A British teacher at a prestigious private boarding school in England which attracts many international students warns that separation from family and home culture is one of the potential downsides of studying overseas. She has witnessed the psychological impact of what is termed boarding-school syndrome on pupils. In extreme cases, it can result in long-term emotional and behavioural difficulties.</p>

<p>Her advice for parents planning to send their offspring to overseas boarding schools is to check the support on offer, the bullying policy, and whether or not there are private rooms. Limited social interaction outside of school and the possibility of racial discrimination against non-white pupils are other concerns facing boarders.</p>

<p>As a counter to these aforementioned drawbacks, she points to the many distinct advantages of attending a British boarding school. It can facilitate entry to a leading university in the UK or the US and access to the global elite, as well as provide fantastic sports facilities and foster independence and self-confidence.</p>

<p>Then, there’s the prestige factor of attending a famous British private school and acquiring the Received Pronunciation English accent, which can open doors in education and social circles. Wealthy Malaysians interviewed for a recent newspaper article admitted that the cachet of speaking with a refined English accent was one of the main attractions of a UK education.</p>



<h3 class="wp-block-heading">Global advancement</h3>



<p>Kevin Lau, Founding Convenor of the Hong Kong Global Youth Professional Advocacy, believes he has benefitted immensely from an overseas education. He was schooled in Canada, then attended Duke University, the University of North Carolina and Stanford University in the US. He also holds a Fellowship from the Royal College of Radiologists in the UK.</p>

He believes Hong Kong students make their choices based on cost, English instruction, cultural fit and career opportunities, and often favour these English-speaking nations. “Factors like proximity and scholarships also influence decisions,” he adds, noting that the National University of Singapore is a top Asian option.</p>

This expansion of the luxurious Norfolk retreat gives the magnificent complex an extra string to its extensive bow of spa facilities. These span a hydrotherapy pool, rainforest showers, hot tub and cold water therapy, steam room, sauna, foot spa and rasul mud chamber, with 10 therapists on hand to cater to every need. Aside for the usual ingredients, the beer bath contains the hotel’s signature mineral salts, while unlimited in-treatment pours come via the local Woodforde’s Brewery.</p>



<h3 class="wp-block-heading">Home to heal</h3>



<p>For many devotees, the spiritual home of the beer bath is Spa Beerland Prague Hradčany. Registered as a national cultural monument, this historic 17th-century house in Prague was a place of residence of the famous Renaissance astrologer and alchemist Tycho Brahe. The Dane, along with his Czech scientific colleague Tadeáš Hájek, studied the qualities of beer and is thought to be among the first to point to its healing properties.</p>

<p>With this in mind, many legal advisers are suggesting couples should consider this eventuality – however, painful – and draw up a prenuptial agreement well ahead of the wedding day. Such contracts have become increasingly popular in the Western world, and it is far easier and less onerous to outline arrangements for a potential split beforehand, rather than when trust in a marriage breaks down.</p>

<p>“It can sometimes be a delicate conversation to have following an engagement, and it is important to choose the moment carefully,” says Vanessa Duff, a Partner at law firm Charles Russell Speechlys, who advises high-net-worth individuals on all aspects of family law.a</p>



<h3 class="wp-block-heading">Division of spoils</h3>



<p>A prenuptial agreement will normally set out how to divide assets on a future breakdown of the marriage, as well as address the welfare of any minor children. It should deal with pre-marital wealth, and what happens to assets built up during the marriage or received during the marriage from a non-matrimonial source, such as inheritance. Ideally, both parties should have independent legal advice; there should be an absence of pressure or duress; and the agreement should be signed a minimum of 28 days before the wedding.</p>

<p>“Prenuptial agreements are recommended for those who may be entering into a (possibly second or third) marriage in later life and wish to protect their children and assets they have built up in the past,” says Duff. Having such an agreement is crucial, she adds, in cases where one party has significant inherited wealth or a business to protect.</p>

<p>She believes the attitude of the Hong Kong younger generation to prenups is much more accepting and practical today than it was in previous decades, especially for those who legally hold assets on behalf of their parents or relatives. “It is therefore essential to clarify in such an agreement that those assets belong to a third party,” she says.</p>



<h3 class="wp-block-heading">Pre-wedding planning</h3>



<p>All relationships go through tricky spells from time to time, and no one can foretell the future with certainty. A breakdown of trust happens when transfers of assets to third parties are discovered later in the relationship, without any prior discussion or agreement. “It is always better to discuss and agree this in advance with the other party,” she advises.</p>

<p>She indicates this exchange of financial information is part of a wider picture of building up trust in a relationship, where transparency and openness is key, and candidly talking about expectations with regard to working arrangements and who will look after the children.</p>

<p>There are risks on relying on the courts to settle the financial arrangements of a break up. As Duff points out: “That means pre-acquired and inherited assets are also potentially vulnerable. Without an agreement it is difficult to ringfence certain assets and ensure that the interests of children from a former relationship are protected.”</p>



<h3 class="wp-block-heading">Equal split</h3>



<p>“The starting point in Hong Kong in the event of a divorce is for all worldwide assets to be divided 50/50, irrespective of their origin, and there is also a presumption that both parties are to be treated equally and fairly,” says Duff.</p>

<p>“If done correctly, a prenuptial agreement will carry significant weight with the court. Any prenuptial will need to ensure that the reasonable financial needs of both parties are met.”</p>

<p>Duff says the court will only depart from equality if there are ‘good reasons’ for doing so. “Without a prenup, it relies on the lawyers to come up with legal arguments and ‘good reasons’ as to why these assets should not be included in the event of a divorce.”</p>



<h3 class="wp-block-heading">Legal grey area</h3>



<p>Hong Kong-based lawyer Sanjeev Aaron Williams says that a prenup serves as a point of reference for the courts, but cautions that they have the power to review whether the terms are reasonable. He advises parties entering into such an agreement to seek certainty of jurisdiction and governing law.</p>

<p>Ultimately, having a prenuptial agreement provides a couple with a degree of certainty and predictability, rather than leaving it to the court system to decide. It minimises financial anxiety and offers reassurance in the eventuality of an end to their marriage.</p>



<h3 class="wp-block-heading">In trusts we trust</h3>



<p>Another legal mechanism to consider when protecting wealth and pre-acquired assets in the event of divorce is a trust. “Trusts are becoming an increasingly popular wealth-planning tool, especially for high-net-worth individuals,” notes Jocelyn Tsao, a Partner at Withers’ Hong Kong office. “The usual objectives would be to minimise tax, protect assets from potential creditors, and plan for succession</p>

<p>Since most trusts are set up with the primary purpose of estate planning and asset protection, they may not address the contingency of a divorce. Tsao warns of the dangers of this oversight, saying: “Without considering divorce in a trust arrangement, some aspects of the trust setup might render the trust vulnerable to being ‘attacked’ in a divorce situation.”</p>

<p>She points out that the Hong Kong court has the power to vary any nuptial settlement, and it may regard the trust as a financial resource even if it was established prior to marriage. This scenario in case of divorce would render assets held in trust vulnerable to being shared by a divorcing spouse or the divorcing spouse of a couple’s child.</p>

<p>“Hence, more individuals and families who plan to set up trusts now are seeking advice on how to ensure that the wealth held in the trust would be safe from being shared in the event of a divorce,” says Tsao.</p>



<h3 class="wp-block-heading">Spousal claims</h3>



<p>Anisha Ramanathan, a fellow Partner at Withers in Hong Kong, reveals that it is important to get spousal consent before setting up a trust during a marriage so as to demonstrate that it wasn’t established specifically to defeat the legitimate claims of the other party in the event of divorce.</p>

<p>It is possible to re-settle or restructure the trust after it has been set up, though Tsao warns that “such variation may be seen as an attempt to defeat a divorcing spouse’s claim if it is done three years prior to the divorce ¬– in which case the court has the power to set aside such variation.”</p>

<p>The independence of the trustee is another key consideration when establishing a trust, especially if the marriage ends in divorce. It is the trustee who controls the assets in the trust and makes decisions on its administration and asset investment.</p>

<p>“Divorce can impact the trust where proceedings involve either the settlor or the beneficiaries. In either case, the trustees should show themselves to be independent and there may be cost consequences if they act inappropriately,” says Ramanathan. She highlights the landmark 2014 case of Kan Lai Kwan v Poon Lok To Otto, in which the court considered the trustees were not acting independently and decided in favour of the wife.</p>



<h3 class="wp-block-heading">Nuptial necessities</h3>



<p>In an ideal world it is best to have both a prenuptial agreement and a postnuptial agreement in place in terms of protecting your assets in a trust, according to Billy Ko, another Hong Kong Partner at Withers. “As the name postnuptial agreement suggests, such an agreement is signed after marriage, and therefore the possible argument of being forced to sign the agreement under duress and undue pressure becomes less persuasive if the couple has gotten married already,” he says.</p>

<p>He also warns nuptial agreements are not “bullet proof”, and it is equally important for the party(ies) seeking protection to handle their finances properly during marriage. “For this reason, if there’s any particular asset that one would like to protect, it is important that it is ‘ringfenced’ and kept entirely separate from your spouse,” he emphasises.</p>

<p>Every scenario should be considered when one is wealth planning, including the possibility of one of the partners in the marriage losing mental capacity. “In order to avoid this, one could sign an Enduring Power of Attorney to appoint one or more individuals to manage the donor’s finances in the event the donor loses the mental capacity to do so,” he says.</p>


Divorce in Reality: Before couples become entwined in marriage, they need to protect their assets should things fall apart
